The Chief Human Capital Officers Act of 2002, enacted as part of the Homeland Security Act of 2002 (Pub. L. No. 107-296) on November 25, 2002, required the heads of 24 Executive Departments and agencies to appoint or designate Chief Human Capital Officers (CHCOs). Each CHCO serves as his or her agency’s chief policy advisor on all human resources management issues and is charged with selecting, developing, training, and managing a high-quality, productive workforce. The CHCO Act also established a Chief Human Capital Officers Council to advise and coordinate the activities of members’ agencies on such matters as the modernization of human resources systems, improved quality of human resources information, and legislation affecting human resources operations and organizations. The Council is composed of the Director of the Office of Personnel Management (OPM), who serves as chairman; the Deputy Director for Management of the Office of Management and Budget (OMB), who acts as vice chairman; the CHCOs of the 15 Executive departments; and the CHCOs of 12 additional agencies designated by the OPM Director. Additionally, the Council has an Executive Director who coordinates and oversees the activities of the Council. The SMDC/ARSTRAT is built upon a lengthy history of achievement in space and missile defense. Since 1957, when the Army created the first program office for ballistic missile defense, the command has dedicated itself to missile defense research, development and deployment. In December 1962, the command made history with the first successful intercept of an ICBM reentry vehicle with the Nike-Zeus. History was repeated in the 1980s with a new non-nuclear technology. The kinetic energy concept of “hitting a bullet with a bullet” was first proven in June 1984 with the intercept of an ICBM warhead in the Homing Overlay Experiment. In 1987, the Flexible Lightweight Agile Guided Experiment confirmed the concept against shorter-range tactical missiles. Nearly a decade later, the command demonstrated the missile defense applications of directed energy systems. In February 1996, the Mid Infrared Advanced Chemical Laser destroyed a short-range rocket in flight.

The Merit Systems Protection Board is an independent, quasi-judicial agency in the Executive branch that serves as the guardian of Federal merit systems. The Board was established by Reorganization Plan No. 2 of 1978, which was codified by the Civil Service Reform Act of 1978 (CSRA), Public Law No. 95-454. The CSRA, which became effective January 11, 1979, replaced the Civil Service Commission with three new independent agencies: Office of Personnel Management (OPM), which manages the Federal work force; Federal Labor Relations Authority (FLRA), which oversees Federal labor-management relations; and, the Board. The Board assumed the employee appeals function of the Civil Service Commission and was given new responsibilities to perform merit systems studies and to review the significant actions of OPM. The CSRA also created the Office of Special Counsel (OSC) which investigates allegations of prohibited personnel practices, prosecutes violators of civil service rules and regulations, and enforces the Hatch Act. Although originally established as an office of the Board, the OSC now functions independently as a prosecutor of cases before the Board. (In July 1989, the Office of Special Counsel became an independent Executive branch agency.)
